Chadwick大法官引用了Denning勋爵在General Accident Car and Life Assurance Corporation Ltd v Foster [1972] 3 All ER 877一案中的观点：

... by reference to the comparable provisions then in the Legal Aid Act 1964, he(Denning勋爵) said this:
"The first point is: what are the 'proceedings'? Are they the proceedings from beginning to end - from the very first time when legal aid was granted? I think not. The only 'proceedings' with which we are concerned is the interlocutory appeal to this court, which we heard on 19 January 1971 ..... "（at 880B)
